Summary:

Cathedral Appointments has an exceptional opportunity for an experienced Court of Protection Lawyer to join a growing, reputable law firm in their Newton Abbot office.   The successful candidate will have a minimum of 3 years’ PQE gained within Private Client work and will have demonstrable experience and a real interest in Court Protection work.

 

What will you be doing as a Court of Protection Lawyer :

 

  • You will be able to independently run your own busy, varied caseload of Court of Protection matters, to include below:
  • Preparation of COP applications to include Deputy applications and ancillary applications such as applications relating to Statutory Wills and gifts etc
  • Planning, organisation and monitoring of general management of financial affairs, household and other expenditure to include being able to budget and manage financial schedules
  • Preparation of annual Deputy Reports to the OPG, dealing with Costs Draftsman and the Senior Court Costs Office in relation to billing to include e-billing
  • Dealing directly with and advising elderly, disabled and vulnerable individuals in the everyday execution of their financial and personal affairs
  • Acting in the protection of those clients from abuse, coercion and exploitation
  • Dealing with and advising the family of our clients, lay Attorneys and lay Deputies
  • Working with Case Managers, Managers of Care/Residential/Nursing Homes and other professionals/experts
  • Advising on challenges to Deprivation of Liberty Safeguards and working with representatives such as IMCAs
  • Having an awareness of and being able to identify potential tax issues
  • Having an awareness of and being able to identify care funding needs, deliberate deprivation of assets, and benefit issues
  • Having experience of dealing with the sale, purchase and adaption of properties through the COP to meet the Patient’s needs and requirements
  • Being knowledgeable in and able to advise on the Mental Capacity Act and other related rules, regulations and legislation such as the Care Act

 

Skills/Qualifications of a Court of Protection Lawyer:

 

  • You will be a qualified Solicitor or Legal Executive with a minimum of 3 years’ PQE gained specifically within Court of Protection work
  • You will pride yourself on having exceptional client care skills and you will have an affinity with dealing with the elderly, disabled and vulnerable persons and you will be focused on helping your clients manage their finances and their lives for the better
  • You will be a professional, organised, competent, enthusiastic team player
  • ACTAPS and/or STEP membership welcomed but not essential
  • You will be happy to undertake networking and business development opportunities as required
  • You will have a full driving licence and access to a car as travel will be required
